On January 23, 2025, a competition to fill vacant positions of judges in the Appeals Chamber of the High Anti-Corruption Court was announced

The decision of the High Qualification Commission of Judges of Ukraine of
January 23, 2025 announced a competition for vacant positions of judges in the Appeals Chamber of the High Anti-Corruption Court and approved the terms and conditions of the competition, according to which:  

 1. The competition for vacant positions of judges in the Appeals Chamber of the High Anti-Corruption Court (hereinafter the Competition) is conducted by the High Qualification Commission of Judges of Ukraine in accordance with the Law of Ukraine On the Judiciary and the Status of Judges, the Law of Ukraine On the High Anti-Corruption Court, the Regulations on the Competition for Vacant Position of a Judge and the decision of the Commission.

2. For the purposes of the competition announced on January 23, 2025, 10 positions of judges in the Appeals Chamber of the High Anti-Corruption Court are vacant.

3. The deadline for submission of documents and applications for participation in the competition and for qualification evaluation is from April 01 to April 30, 2025 (inclusive).

4. The application and documents for participation in the Competition shall be submitted in electronic form through the official website of the Commission (ksk.vkksu.gov.ua).

4.1 Within the time limit set by the Commission and within the framework of the announced Competition, a candidate may submit only one application for participation in the Competition and for the qualification evaluation. Repeated application is not allowed.

4.2. The documents submitted for participation in the Competition must be suitable with the requirements of the Regulations on Holding a Competition for a Vacant Judicial Position, approved by the Commission’s decision of November 02, 2016,  141/zp-16 (as amended by the Commission’s decision of  February 29, 2024,  № 72/zp-24).

5. The application and documents for participation in the Competition are:

5.1. An application for participation in the Competition and for qualification evaluation in the form and content in accordance with Annex 1 to these conditions (in Ukrainian).

It shall be submitted in electronic form by filling in the appropriate template.

5.2. A copy of an identity document confirming the citizenship of Ukraine.

It is submitted by uploading a scanned copy of the passport of a citizen of Ukraine in the form of a booklet, which must contain copies of all its filled pages. A copy of the passport of a citizen of Ukraine in the form of a card must contain the front and back sides of the passport and be made on one sheet, with a copy of the front side in the upper part and the back side in the lower part. Together with a copy of the passport of a citizen of Ukraine in the form of a card, a copy of the extract from the register of the territorial community is submitted to confirm the information on the place of residence (stay).

5.3. Questionnaire of a candidate for the position of a judge.

It shall be submitted in electronic form by filling in the application form approved by the Commission’s decision . 121/zp-23 dated November 02, 2023 (as amended).

5.4. Motivation letter of the candidate for the position of a judge.

It shall be submitted in electronic form by filling in the form approved by the Commission’s decision 121/zp-23 dated November 02, 2023 (as amended).

5.5. Declaration of family ties of a candidate for the position of a judge.

It shall be submitted by uploading the relevant electronic form filled in on the official website of the Commission (cab.vkksu.gov.ua) in accordance with the rules for filling in and submitting such a declaration.

5.6. Declaration of integrity of a candidate for the position of a judge.

It shall be submitted by uploading the relevant electronic form filled in on the official website of the Commission (cab.vkksu.gov.ua) in accordance with the rules for filling in and submitting such a declaration.

5.7. A copy of a diploma of higher legal education (with appendices) obtained in Ukraine and/or a copy of a document on higher legal education obtained abroad, together with a copy of a document confirming its recognition in Ukraine.

They shall be submitted by uploading a scanned copy of the original document.

5.8. A copy of the document on academic degree, academic title, postgraduate or doctoral studies in full-time (full-time) education (if any).

It is submitted by uploading a scanned copy of the original document.

5.9. Copies of documents confirming the length of professional activity in the field of law.

They shall be submitted by uploading scanned copies of the original or copies of the documents.

5.10. Documents in the prescribed form from medical institutions on psychiatric and narcological examinations.

  Submitted by uploading a scanned copy of the original certificate of completion of preliminary, periodic, and extraordinary psychiatric examinations in the form of primary accounting documentation № 100-2/o, issued after the Commission’s decision to announce the Competition (unless a different document is established by the central executive authority responsible for the formation of state health policy).

5.11. A written consent to the collection, storage, processing, and use of information about the candidate for a judicial position to assess their readiness to serve as a judge.

Submitted in electronic form by filling out the appropriate template.

5.12. Consent to conduct a special verification in accordance with the Law of Ukraine On the Judiciary and the Status of Judges and documents required for the special verification under the Law of Ukraine On Prevention of Corruption.

Submitted by uploading scanned copies of the originals and copies of the documents.

5.12.1. Consent to conduct a special verification under the Law of Ukraine On the Judiciary and the Status of Judges”.

Submitted by uploading a scanned written consent in the form of Annex 1 to the Procedure for Conducting Special Verification Regarding Persons Applying for Positions Involving Significant Responsibility or High Corruption Risks, approved by the Resolution of the Cabinet of Ministers of Ukraine № 171 of March 25, 2015.

5.12.2. Autobiography.

Submitted by uploading a scanned autobiography prepared as of the date of consent to conduct the special verification.

5.12.3. A copy of the military registration document (if available).

Submitted by uploading a scanned copy of all completed pages of the document.

5.12.4. Certificate of access to state secrets (if available).

Submitted by uploading a scanned copy of the certificate.

5.12.5. A statement under Part 1 of Article 6 of the Law of Ukraine On Lustration.

Submitted by uploading a scanned written statement with annexes.

5.13. A copy of the declaration of a person authorized to perform the functions of the state or local self-government, covering the year preceding the year of document submission, along with a link to the relevant page of the Unified State Register of Declarations.

The declaration copy is submitted by uploading a saved or printed and scanned copy of the declaration, containing restricted access information (not displayed publicly). A form is completed to provide the link to the relevant page of the Unified State Register of Declarations.

5.14. A copy of the document confirming proficiency in the state language in accordance with the level determined by the National Commission on State Language Standards.

Submitted by uploading a scanned extract from the Register of State Certificates of Proficiency in the State Language or a State Certificate of Language Proficiency.

A form is completed to provide the link to the Register of State Certificates of Proficiency in the State Language.

5.15. Documents confirming compliance with the requirements set forth in Article 69 of the Law of Ukraine On the Judiciary and the Status of Judges.

Submitted by uploading scanned copies of the originals or copies of the documents.

5.15.1. An extract from the Information and Analytical System Record of Data on a Persons Criminal Responsibility and Convictions.

Submitted by uploading scanned copies of the original document issued after the Commission’s decision to announce the Competition.

5.15.2. Recommendations characterizing the judicial candidate and confirming compliance with Article 69 of the Law of Ukraine On the Judiciary and the Status of Judges (if available).

Submitted by uploading scanned recommendations issued after the Commission’s decision to announce the Competition.

5.15.3. Certificate of the results of the lustration verification under the Law of Ukraine On Lustration issued by the respective authority conducting such verification (if available).

Submitted by uploading a scanned copy of the certificate.

5.16. Documents confirming compliance with one of the requirements set forth in Part 2 of Article 7 of the Law of Ukraine On the High Anti-Corruption Court.

Submitted by uploading scanned copies of the originals or copies of the documents.

5.17. A statement confirming the absence of circumstances specified in Part 4 of Article 7 of the Law of Ukraine On the High Anti-Corruption Court, in accordance with Annex 2 (in Ukrainian) to the Conditions for the Competition for Vacant Judicial Positions in the Appeals Chamber of the High Anti-Corruption Court, announced on January 23, 2025.

6. If the submission of the same document is required under different sections of these conditions, the document is submitted in a single copy.

7. Individuals are admitted to the Competition if:

they have submitted all required documents within the timeframe and manner determined by the Commission;

as of the date of document submission, they meet the requirements established in Articles 33, 69, and 79³ of the Law of Ukraine On the Judiciary and the Status of Judges, as well as Article 7 of the Law of Ukraine On the High Anti-Corruption Court.

8. An individual participating in the Competition who is not a judge must submit declarations of family ties and integrity annually by May 1.

9. An individual participating in the Competition who is not required to annually submit a declaration as a person authorized to perform the functions of the state or local self-government must submit such a declaration annually by April 1 as a judicial candidate.
